These Terms & Conditions describe general policies for flooring products, carpet and flooring installation, payments, scheduling, and customer communications provided by The Carpet Company, Inc. (“Company,” “we,” “us,” or “our”). The specific scope, materials, price, schedule, and project requirements are set out in the applicable approved estimate, proposal, purchase order, or written project agreement.
1. Project Agreements and Order of Documents
The applicable written project agreement controls the specific work to be performed, materials, price, payment schedule, estimated dates, warranties, and other project-specific terms. These Terms & Conditions apply to the extent they are consistent with that agreement and applicable law. If a conflict exists, the documents will be interpreted under applicable law, giving effect to the signed project agreement where legally permitted.
Nothing in these Terms & Conditions limits a right or remedy that cannot legally be waived or excluded.
2. Estimates, Measurements, and Scope of Work
Estimates are based on the information, measurements, materials, labor, site conditions, and scope identified in the estimate. Actual conditions discovered at the site, customer-requested changes, material availability, or changes in scope may affect the price or schedule.
Material changes to the agreed scope or price will be documented and submitted for customer approval as required by the project agreement and applicable law. Additional work or charges will not be treated as approved solely because the Company has identified a possible change.
For residential projects subject to Virginia contractor requirements, the required written contract will be completed and signed before work begins or payment is accepted when required by law. The Company may provide contract disclosures and notices required for the particular transaction.
3. Deposits and Payment Schedule
Deposits, progress payments, and final payments are due according to the approved written project agreement or invoice. The agreement will identify the total project price, applicable deposit, payment schedule, and any other required payment terms. Deposit amounts and payment timing will comply with applicable law.
A payment link may be sent by text message, email, or another agreed communication method. Before submitting payment, customers should verify that the request is associated with The Carpet Company, Inc. If a payment request appears suspicious, do not use the link; contact the Company using the contact details in the project documents. The company is not responsible for payments made to erroneous or fraudulent links.
4. Invoices, Disputes, and Final Payments
Invoices will identify the amount due and, where applicable, the project or invoice reference. Final payment is due according to the payment schedule and completion terms in the written project agreement. Customers should promptly contact the Company with questions about an invoice, disputed charges, or payment arrangements. Invoices shall be considered accepted between the parties without dispute after five days of receipt.
A text message or email containing a payment link is a convenience and does not change the amount due, payment schedule, or other terms of the signed project agreement unless the parties agree to a change in writing. All company work, changes, upgrades, or alterations require a writing signed by the company. No oral medications, statements, promised or changes outside a written modification shall be considered as binding or part of the project contract. The Carpet Co. works only through written contracts, change orders and modifications, not through any oral discussions. Customer reliance on any oral modifications or agreements is not valid or binding on the company.
5. Payment Processing and Sensitive Information
Payments may be processed through a third-party payment service. The provider’s terms and privacy practices may apply to transactions completed through its platform. The Company may receive transaction confirmations, payment status, receipts, transaction identifiers, and other information reasonably needed for billing and recordkeeping.
Customers should not send full credit-card numbers, card security codes, bank account credentials, or online banking passwords through ordinary text message or email. Use only a payment method or platform identified or verified by the Company. Any processing fees or additional payment terms will be disclosed as required by law and the applicable agreement.
6. Scheduling, Access, and Delays
Installation dates and estimated completion dates will be stated in the applicable project agreement. Scheduling may be affected by material availability, site readiness, unforeseen site conditions, weather, supply interruptions, or other circumstances beyond the Company’s reasonable control. The Company will communicate material changes as reasonably practicable.
Customers are responsible for providing reasonable access to the work area and communicating relevant site conditions before installation. Requirements concerning furniture removal, removal of existing flooring, subfloor preparation, pets, parking, access, or other preparation will be identified in the estimate or project agreement, as applicable.
7. Changes and Additional Work
Customer-requested changes, additional work, or work required because of conditions not reasonably apparent when the estimate was prepared will be handled in accordance with the project agreement and applicable law. Where approval is required, the Company will obtain it before proceeding with the additional work, except as permitted by applicable law or an agreed emergency procedure. Weather conditions or material interruptions caused by suppliers are agreed emergency conditions that the parties accept and understand may change schedules without notice.
8. Cancellations, Changes, and Refunds
Cancellation requests, rescheduling, order changes, returns, and refund requests will be handled according to the signed project agreement and applicable law. Any cancellation, restocking, special-order material, or refund terms will be disclosed as required by law and will not eliminate any statutory rights that apply to the customer.
Nothing in these Terms & Conditions waives an applicable statutory cancellation right, including any right that may apply to certain home-solicited sales. Customers should review the project agreement for transaction-specific cancellation instructions and deadlines.
9. Installation Quality and Warranties
Any workmanship warranty offered by the Company will be described in the applicable written warranty or project agreement. Manufacturer warranties are governed by the applicable manufacturer’s terms. Customers should notify the Company promptly if they identify a concern with completed installation work and provide reasonable information needed to evaluate it.
Nothing in these Terms & Conditions excludes warranties, duties, or remedies that cannot legally be excluded or limited.
10. Service and Payment Text Messages
Where the customer has provided an appropriate telephone number and any consent required by law, the Company may send service-related text messages about the customer’s inquiry or transaction, including appointment confirmations and reminders, installation scheduling and project updates, estimates, invoices, payment links, payment reminders, receipts, and responses to customer inquiries.
Message frequency varies according to project activity. Message and data rates may apply depending on the customer’s mobile plan. Where supported, customers may reply STOP to opt out and HELP for assistance. Customers may also contact the Company at the phone number or email below to request that messages cease. The Company will process revocation requests as required by applicable law and the messaging provider’s procedures.
The Company will not use the service-message program to send promotional marketing messages unless it has obtained the consent and provided the disclosures required by applicable law. Providing a telephone number for service or payment communications does not by itself constitute consent to marketing messages where separate consent is required.
Opting out of text messages does not cancel a project agreement, erase an outstanding balance, or prevent the Company from using other lawful methods to communicate about an existing transaction. The Company may retain a limited record of an opt-out to ensure that the request is honored.
11. Privacy and Customer Information
The Company’s collection, use, sharing, retention, and protection of customer information are described in its Privacy Policy, available at: https://thecarpetcoinc.com/privacy-policy/.
The Company may use third-party payment, messaging, scheduling, accounting, website-hosting, and other service providers to support its business. Such providers may process information needed to provide their services, subject to applicable law and relevant contractual or platform terms.
Customers should not send full payment-card numbers, card security codes, bank account credentials, or other highly sensitive payment information through ordinary text message or email. Customers may contact the Company using the information below with questions or requests concerning personal information.
12. Website and Electronic Communications
Electronic communications may be used for estimates, scheduling, project updates, invoices, receipts, and other business matters where permitted and agreed. Customers should keep contact information current and promptly notify the Company if an email address or telephone number changes. Electronic communications do not amend a signed project agreement unless the applicable agreement and law permit the change and the required approval is obtained.
13. Applicable Law
These Terms & Conditions are intended to be interpreted in accordance with the laws of the Commonwealth of Virginia and applicable federal law. Disputes will be handled in accordance with the applicable project agreement and governing law. Nothing in this section creates a waiver of any non-waivable right or remedy.
